Official Rules

NO PURCHASE NECESSARY TO ENTER OR WIN A PRIZE. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. VOID WHERE PROHIBITED. The entry period for “B&H Gift Card Giveaway“(“Sweepstakes”) begins July 7, 2022 at 12:00 a.m. Eastern Standard Time, and ends at 11:59 p.m. Eastern Standard Time on July 14, 2022 (the “Sweepstakes Period”). All federal, state, provincial and local laws and regulations apply.

Eligibility:

The Sweepstake is open to individuals who meet the following criteria: (a) are eighteen (18) years of age or older and (b) are a legal resident of and physically residing in the United States (excluding Rhode Island, Puerto Rico, Guam, American Samoa, United States territories, possessions, and protectorates, foreign based United States military installations and wherever prohibited by law) (“Entrants”). Neither Sponsor nor employees of Sponsor, and all of their respective parent companies, divisions, subsidiaries, affiliates, and their respective officers, directors, employees, agents, independent contractors, representatives and agencies (collectively, the “Sponsor Entities”) are eligible to participate in the Sweepstakes and/or win a Prize (as defined below). Additionally, immediate family members of such employees and persons living in the same household as such employees (whether related or not) are not eligible to win. For the purposes of this Sweepstakes, “immediate family members” is defined as spouse, domestic partner, mother, father, grandmother, grandfather, children, siblings and their spouses.

By entering this Sweepstakes, Entrant agree to be bound by these Official Rules and the decisions of the Sponsor, which are final and binding in all respects and cannot be challenged or appealed.

How to Enter:

In order to enter the Sweepstakes, Entrant must (a) follow us on Instagram (https://www.instagram.com/shootproof/) and (b) go to shootproof.com/giveaways-and-contests (the “Landing Page”) and complete and submit the entry form during the Sweepstakes Period. Only one entry per person. If multiple entries are received, only the first entry will be considered, and subsequent entries will be disqualified.

Entries received before and/or after the Sweepstakes Period will be void. All entries become the sole property of Sponsor and will not be acknowledged or returned.

Sponsor’s computer will serve as the official timepiece for the Sweepstakes.

Odds of winning are based upon the number of entries.

Prize Drawing:

One winner will be chosen at random on July 15th, 2022. Winner will be notified by email to the email Entrant provided on the submission form. If the winner does not claim the Prize within seven (7) days of being notified, a new winner may be selected and notified. Sponsor is not responsible for any incorrect or inaccurate information, whether caused by tampering, hacking, or by any of the equipment or programming associated with the Sweepstakes. Prize cannot be substituted, assigned, or transferred by winner. Sponsor reserves the right to disqualify Entrants who fail to follow these Official Rules or who make any misrepresentation relative to the Sweepstakes and redemption of a prize.

Tax Issues:

Prizewinner is solely responsible for the reporting and payment of any and all federal, state, provincial and local taxes as well as any other costs and expenses associated with acceptance and use of a Prize not specified herein as being awarded.

No Warranties:

ALL PRIZES ARE PROVIDED “AS IS” AND “with all faults.” Sponsor Entities make no warranties, express or implied, in fact or in law, relative to the use or enjoyment of any prize, or any portion thereof, including, without limitation, its quality, merchantability or fitness for a particular purpose. Any and all warranties for a prize, or any portion thereof, are contained in the manufacturers’ or service providers’ warranties, as relevant.

Entrants agree that Sponsor Entities shall not be liable for losses or injuries of any kind resulting from acceptance/possession and/or use or misuse of any prize, participation in this Sweepstakes, or any technical malfunctions of any network, computer equipment, hardware, software, or any combination thereof, or any entries that are late, incomplete, lost, corrupted, or otherwise not in compliance with these Official Rules. Entrants also agree that the Sponsor Entities are not responsible or liable for any injury or damage to an Entrant’s or third person’s computer related to or resulting from this Sweepstakes and Prize. The Sponsor Entities are not liable for damage to a user’s computer system in any way due to an Entrant’s participation in this Sweepstakes or downloading any information in connection with this Sweepstakes, including without limitation any server failure, lost, delayed or corrupted data or other malfunction. The Sponsor Entities reserve the right to modify or cancel the Sweepstakes in the event that it becomes technically corrupted.

Disputes/Choice of Law:

Except where prohibited, each Entrant agrees that: (1) any and all disputes, claims and causes of action arising out of or connected with this Sweepstakes or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the state or federal courts located in Atlanta, Georgia; (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Sweepstakes, but in no event attorneys’ fees; and (3) under no circumstances will Entrants be permitted to obtain awards for, and Entrants hereby waive all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation, and enforceability of these Official Rules, or the rights and obligations of Entrant and the Sponsor or the Sponsor Entities in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the substantive laws of the State of Georgia, without regard to choice of law rules.
